MetalScan AI uses artificial intelligence to assist users with an indicative identification of metal types and possible visible grade, indicative market values and reporting. Image analysis cannot determine exact purity, composition or certified grade; those require XRF, assay or another approved physical test.

The service is provided as an information and productivity tool only.

Artificial intelligence is not perfect.

MetalScan AI provides estimates based on image analysis and available data.

Results including metal identification, indicative purity, visible grade, confidence score and estimated value are indicative only and are not an assay, certification or valuation.

Users must independently verify all results before buying, selling or relying on any information for commercial decisions.

MetalScan AI accepts no responsibility for losses resulting from reliance on AI-generated outputs.

Users are responsible for:

• Maintaining password security
• Keeping account information accurate
• All activity occurring under their account

Users agree not to:

• Upload illegal material
• Attempt to hack or disrupt the platform
• Copy or reverse engineer the software
• Upload malicious software
• Use MetalScan AI for unlawful purposes

Subscription fees are billed in advance and automatically renew unless cancelled.

Payments are securely processed by Stripe or other authorised payment providers.

MetalScan AI does not store payment card details.

All software, branding, logos, AI models, images, content and code remain the exclusive property of MetalScan AI.

No content may be copied or reproduced without written permission.

To the maximum extent permitted by law, MetalScan AI is not liable for:

• Incorrect AI identification
• Pricing inaccuracies
• Loss of profits
• Business interruption
• Indirect or consequential damages

Maximum liability shall not exceed the amount paid by the user during the previous 12 months.

Private messages, group chats and shared files are encrypted on your device before sending and in transit, and calls use the browser's standard DTLS-SRTP media encryption. This encryption architecture has not been independently audited or certified, so we make no claim of verified end-to-end encryption. MetalScan AI staff have no general ability to read private conversations.

Where a message or conversation is reported, or where we are investigating a safety issue such as fraud, abuse or threats, or where we are required to act under a legal obligation, an administrator may authorise a named moderation staff member to review that specific conversation for a limited period.

Each authorisation and each review is logged with the staff member's identity, the reason, the ground relied on and the date and time. Access expires automatically and may be revoked at any time. By using MetalScan AI messaging you acknowledge that reported conversations may be reviewed in this way.

Attempting to obtain access to another user's private conversations, or misusing moderation access, is a serious breach of these Terms and may result in suspension and referral to authorities.

MetalScan AI operates a venue that connects buyers and sellers. We are not the buyer, seller, agent, broker, valuer or assayer of any material listed, and we do not take title to or possession of goods. Every contract of sale is formed directly between buyer and seller.

Seller responsibilities

• You must have lawful title to the material and the right to sell it, free of any lien, charge or third-party claim.
• Listings must accurately state metal type, visible grade, weight, quantity, condition, contamination and location. AI results are indicative only and are not a substitute for assay or XRF results.
• Stolen material and prohibited or restricted items must never be listed. This includes suspected stolen infrastructure, cable, plaques, catalytic converters or utility metal, radioactive or hazardous material, munitions, sanctioned goods, and any metal whose sale requires a licence you do not hold.
• You must comply with all scrap-dealer licensing, identity-recording, cash-payment and reporting laws in your jurisdiction.
• You must ship the material described, within the timeframe stated in the listing, with accurate documentation.

Buyer responsibilities

• You are responsible for satisfying yourself as to type, grade, purity, weight and condition before purchase.
• Inspection, sampling, weighing and professional testing are your responsibility unless the seller agrees otherwise in writing.
• You must comply with import, transport, environmental and licensing requirements applying to the material.
• You must pay in full through the platform's supported payment methods. Off-platform payments are at your own risk and are not covered by platform protections.

Inspection, ownership and risk

Unless the parties agree otherwise, title passes on full payment and risk passes on collection or handover to the courier. Any inspection window agreed between the parties must be stated in the listing or negotiation record.

Shipping, customs and taxes

Shipping arrangements, freight cost, insurance, customs clearance, duties and import taxes are the responsibility of the party identified in the listing, and by default the buyer. Prices shown exclude taxes unless stated. Each party is responsible for its own tax registration, invoicing and remittance obligations, including GST or VAT.

Platform fees and payment release

MetalScan AI charges a marketplace transaction fee of between 1% and 2.5% of the transaction value, together with any applicable subscription charges. The fee applicable to a transaction is displayed before you confirm it. Payment provider fees may also apply. Funds are released to the seller after the payment has cleared and the order has been confirmed as dispatched or delivered in accordance with the order's tracking record.

Cancellations, disputes and refunds

• Either party may cancel before payment. After payment, cancellation requires the other party's agreement unless the goods have not been dispatched within the stated timeframe.
• Disputes must first be raised with the other party through the platform's messaging and dispute tools within 7 days of delivery or of the expected delivery date.
• If the parties cannot resolve the dispute, MetalScan AI may review the order, tracking, messaging and documentation record and may hold, reverse or release funds. Our decision is administrative and does not prevent either party pursuing legal remedies.
• Refunds for material that is materially not as described are the seller's responsibility. Platform fees may be refunded where a transaction is cancelled before dispatch.
• Non-excludable consumer guarantees and statutory rights are not affected by these Terms.

We may remove listings, suspend accounts, reverse verification badges and report conduct to law enforcement where we reasonably suspect fraud, impersonation, prohibited material or stolen goods.

We aim for high availability but cannot guarantee uninterrupted access.

Maintenance and outages may occur.

We may update these Terms at any time.

Continued use of MetalScan AI constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Australia.
